General Terms and Conditions (GTC) - "Ferienwohnung in der Freiheit" Landlord: David Mies, 5727 Hachenburg, Germany
By booking the holiday flat, the following terms and conditions are accepted. Deviations or other agreements are only valid if accepted in writing.
1 Arrival / Departure
Arrival and departure times can be agreed individually. In the absence of a written agreement to the contrary, departure shall be by 11.30 a.m. at the latest on the day of departure. Exceeding the departure time by more than 120 minutes will result in the charging of an additional overnight stay. Unless otherwise agreed, arrival shall be by 5.00 p.m. on the day of arrival. Should the tenant fail to appear unannounced by 9.00 p.m. on the day of arrival, the contract shall be deemed terminated after a period of 24 hours without notification to the landlord. The landlord or his representative may then freely dispose of the property. The agreed rent shall nevertheless be due. A (pro rata) repayment of the rent due to early departure will not be made as a matter of principle.
2. special requests and ancillary agreements
are possible in principle. They require written confirmation by the landlord. Pets are not allowed. The flat is a non-smoking flat.
3. payment
The rental contract becomes valid upon confirmation by the landlord. Payment is to be made on arrival or in advance to our account. Alternatively, payment can also be made by Paypal. If the payment deadlines are not met, the landlord can withdraw from the contract. Non-payment is considered as withdrawal and entitles to re-letting. Additional costs for water, parking space, waste are not charged. The use of the wallbox is subject to separate agreement and will be charged separately.
4 Withdrawal
You can withdraw from the contract at any time. The withdrawal must be made in writing. In the event of withdrawal, the following agreements apply:
- from the day of booking confirmation by the lessor until the 31st day before the start of the rental period, no compensation,
- from the 21st day to the 10th day before the start of the rental period 15% of the total price,
- from the 9th day to the 5th day before the start of the rental period 30% of the total price,
- in case of cancellation from the 4th day until the beginning of the rental period 75% of the total price will be due.
Cancellation by the landlord
In the event of cancellation on our part, as a result of force majeure or other unforeseeable circumstances (such as accident or illness on the part of the hosts) as well as other circumstances for which we are not responsible, making fulfilment impossible; liability is limited to reimbursement of the rental costs already paid. In the event of justified withdrawal, the customer shall have no claim to compensation - no liability shall be assumed for travel and hotel costs.
Cancellation by the lessor can take place after the start of the rental period without observing a period of notice if the lessee, despite a warning, behaves in a way contrary to the contract that justifies the immediate cancellation of the rental agreement.
5. Use
The holiday flat may only be used by the persons listed in the booking. If the flat is used by more persons than agreed, a separate fee is to be paid for these, by which the rental price is increased. In this case, the landlord also has the right to terminate the rental contract without notice.
It is not permitted to let the flat to third parties.
6. obligations of the tenant
The tenant undertakes to treat the rented property (holiday flat, inventory and outdoor facilities) with care. If damage to the holiday flat and/or its inventory occurs during the tenancy, the tenant is obliged to report this immediately to the landlord. Defects and damages already detected upon arrival must be reported to the landlord immediately, otherwise the tenant is liable for these damages. A reasonable period of time must be allowed for the rectification of damage and defects. Claims arising from complaints which are not reported immediately on site are excluded. Complaints which are only received by the landlord at the end of the stay or after leaving the holiday home are also excluded from compensation. In the event of any service disruptions occurring, the tenant is obliged to do everything reasonable within the scope of his legal obligation to contribute to the rectification of the disruption and to keep any damage incurred to a minimum. On the day of departure, personal belongings must be removed by the tenant, household waste must be disposed of in the containers provided, crockery must be stored clean and washed up in the kitchen cupboards.

The tenant agrees that within the framework of the contract concluded with him necessary data about his person will be stored, changed and / or deleted. All personal data will be treated with absolute confidentiality.
8. liability
The invitation to tender has been prepared to the best of our knowledge. No liability shall be accepted for the rental object being affected by force majeure, by power and water failures customary in the country and by storms. Likewise, no liability is accepted in the event of unforeseeable or unavoidable circumstances such as official orders, sudden construction sites or disruptions due to natural or local conditions. However, the landlord will be happy to assist in rectifying the problems (insofar as this is possible). Any liability of the landlord for the use of the provided objects is excluded. The arrival and departure of the tenant is his own responsibility and liability. The landlord is not liable for personal belongings in case of theft or fire. The lessee shall be fully liable for wilful destruction or damage.
9. final provisions
Photos and text on the website or in the flyer serve the purpose of realistic description. A 100% match with the rental object cannot be guaranteed. The lessor reserves the right to make changes to the equipment (e.g. furniture), provided that they are of equal value. Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision which comes as close as possible to the economic and legal intentions of the contracting parties. German law shall apply. The place of jurisdiction and performance is the place of residence of the lessor.
We will be happy to welcome you personally on arrival and familiarize you with the apartment and the locking system.
We use an automatic door lock for the main entrance door. With a code that is personalized for you, consisting of 6 numbers, you gain access to the main entrance door. The apartment door of the holiday apartment is opened with a key/lock cylinder.
The parking lot is right in front of the front door and is at your disposal.

Your accommodation is a five-minute walk from the historic city center with small shops and restaurants. A parking space is available in front of the door and has a wall box so that you can charge your electric car, if you wish!
The holiday apartment in Hachenburg itself has an area of 70 square meters and is on the second floor. You reach the apartment via a wide staircase! In the apartment you have a fully equipped kitchen with oven, stove, dishwasher and the necessary kitchen utensils. A large, south-facing terrace invites you to relax when the weather is nice. All rooms are heated by underfloor heating, which can be controlled by you via thermostats. The hot water is prepared by a flow heater! Towels and bed linen are at your disposal.
